It’s harder to make the argument that Cannon is biased in favor of Trump, though I think she is. But she’s demonstrably inept in her rulings according to attorneys I trust.

Trump claims the Presidential Records Act gives him the right to keep the classified documents, when the clear language says the opposite.

Actually, it looks like neither is strictly the case. The PRA was enacted to prevent situations like when TrickyDick sought to destroy records from his time in office, and places all presidential records in public domain – that is, the (ex-)President does not own any of them. However, classified documents are not, per se, presidential records.

If DoD generates a document pertaining to the function of the F-42 Fighting StarShip Bistromath, that is most decidedly not a presidential record – not even if the President sharpies it with little pew-pew-pew blaster rays. Whether an ex-President is allowed to retain classified documents is a matter of whether the current administration decides to extend or to revoke the ex-President's security clearance. Most Presidents do not have their clearance revoked when they leave office, because most Presidents are not puppets to a major foreign power.

According to the National Archives, presidential records are “documentary materials created or received by the President, the President’s immediate staff, or a unit or individual of the Executive Office of the President whose function is to advise or assist the President, in the course of conducting activities which relate to or have an effect upon the carrying out of the constitutional, statutory, or other official or ceremonial duties of the President.” The PRA excludes “documentary materials that are official records of an agency,” so it comes down to whether classified documents qualify as such.

In any event, I would think we agree that the records removed by Trump aren't personal records as defined by the act and that Trump's contention that he had the right to keep any material that crossed his path during his presidency is BS. In this case, Trump's possession of or continued access to classified documents poses a grave threat to national security, since they were at risk of disclosure to foreign actors, whether intentionally or unintentionally.

In programming lingo, Individual-ONE is what would be described as an "edge case", or perhaps a "corner case".
 
As I understand Mr. (yes indeed, for you South Park fans) Hankey is saying that New York cannot regulate them because they are not allowed to do business in New York.

Mr. Hankey is correct. But New York also doesn’t have to accept a bond that would be more than 100% of the available cash that Mr. Hanley has.

It won't matter, he's leading in nearly all of the swing states, even with all of this shit hanging over his head. I hate to be cynical but it's looking like he'll likely beat Biden and will make surely make all of this go away after he takes office. The best we can hope for is he eats one Big Mac too many and suffers the big one in his sleep, otherwise we just need to get used to the idea that he'll run out the clock with another term.
