TFG loses

While this case may be more minor compared to some of the other trouble he's facing, it's nice to finally see something through to the end! Win or lose, it's nice to see even he has to face the consequences of his actions. Hopefully he answers for the rest as well eventually.

I think I'm more interested in seeing him in court than I am in him losing. And I'll admit the petty part of me enjoys seeing him lose. But that aside, he should have to answer for some of what he's done before he just dies. If a jury finds him innocent, I can accept that. But not ever getting to court is maddening. I doubt the people who need to hear the truth will listen, but it would be nice to have it all on the record anyway.

So I'm celebrating the fact that he faced the music even more than the loss and how much he owes and any future appeals and other nonsense.

Except, he does not. Yet. His lawyers (probably new ones as he cannot keep lawyers for more than two weeks) are filing an appeal, and they will keep that up all the way to the Supreme Corrupt. As long as the appeals are pending, the judgement remains on hold.

I totally get that it's not really over. But the original was made and released. What comes after is nothing but a string of sequels. They might be like The Godfather II, Aliens, or The Empire Strikes back. They might be like The Godfather III, Alien 3 or The Phantom Menace. But we'll always have the original. I'll enjoy that while I wait to see if strike gold again or destroy the franchise.

The issue is as follows. Dress had male dna on it. Trump refused to provide DNA for comparison until after the deadline for supplying evidence had passed, and only was willing to do it subject to certain stupid conditions.

In civil court, there wasn’t really a way for Carroll to use the dna - even if she somehow had gotten hold of Trump’s dna to compare it against, she’d have to prove that she was really comparing against his dna.

trumps idea of a fair trial is if he could pick the judge and jury.
 
In normal circumstances I’d find it a little weird given the circumstances that jury found someone guilty of assault but not rape… but then you listen to Trump’s deposition and his remarkably haughty demeanor.

What I really don’t quite understand is the defamation aspect. If she accuses him of rape, he defends himself (indeed using colorful and offensive descriptions), but then is found not liable for rape by the jury, how is that defamation? I’m not sure what damages she incurred by Trumps defamatory statements. Are all the right-wing pundits (and even some left ones) that found her initial claims in 2016 also liable for defamation?

If Trump appeals this case and it is overturned, can he sue Carroll now for defamation? Waiting 25 years to make accusations and having her legal team funded by a Trump political opponent sounds like grounds for one to conclude this is a political hit job.

Best to take the politics out of this, so let’s imagine a similar case involving 2 non-political players no one knew anything about. This would seem like a very convoluted precedent to set making any denials of accused crimes defamatory. And what the cases, often involving drunk college kids, where one or both parties is not really clear as to what happened. One might legitimately believe they did nothing wrong.

But let’s be clear- I am not defending Trump. As far as I’m concerned he’s a pig. The way he talks down to women he opposes is exceptionally disgusting. If he wasn’t liable here, I don’t have much trouble believing he is elsewhere. Admittedly, him losing this case gives me some pleasure.

The narcissist he is, is being the loser of this very public case to a woman he clearly has zero respect for… That’s the real punishment here, not the money.

What she did was add new claims to her original lawsuit, which is still open. That original lawsuit involved statements Trump made while in office, and there has been a delay in that case due to motion practice involving his claim that the statements, true or not, are protected because he made them as part of his duties as president.

Her amendment serves the following purposes:

1) it essentially moots trump’s only defense. The CNN town hall statements were not made when he was president.
2) she is asserting that the only thing left to be tried in this case is damages, because a jury already found essentially similar statements to be false and defamatory
3) she is asking for punitive damages of at least $10 million. Since she is asking for punitive damages, Trump’s finances are now relevant to the case; you can’t know if damages are enough to punish him unless you know how much he has. As a result, Trump will likely have to turn over all sorts of documents and information that he doesn’t want to.

Notably, the day after she did this amendment, Trump once again defamed her on truth social. So the cycle continues for now.
