If it is a federal charge, one should consider that he has a Secret Service detail. They are not per se obligated to follow his orders, and if the Treasury Secretary sees fit to coöperate with DoJ, his detail might well be ordered to deliver him up. It would be a very bad plan for him to try to defy his security detail. And he has minimal control over who is protecting him – he is not really well-known for getting his employees/providers to love him enough go against orders from upstairs.

Seems it will be NY as trump was recently offered the opportunity to come in and testify before the grand jury after his attorneys were advised he could face criminal charges.

"In New York, potential defendants have the right to answer questions in the grand jury before they are indicted, but they rarely testify, and Mr. Trump is likely to decline the offer."

The answer to that question is no, you cannot. Anyone who tells you otherwise is not your friend.

Anyway, with Trump being Trump, how do we even know this supposed arrest is going to take place? He could be drumming up hype for his Save America Again Again presidential campaign tour and BBQ cookoff.

Let me see, Tuesday is the twenty-first. Just throw a 3-2-1 party, hope for fireworks, but just hold a party because, reasons, and have fun. And make sure to serve the tacos out of a truck.

Oh definitely. We always use this one taco truck for catering. I just wish we really did get taco trucks on every corner. Sounds heavenly.

His tweets are pretty concerning given his history. He has every right to defend himself, but phrases like “protest, take back America” might not age well.

I have listened to legal experts on both sides of this. I think everyone agrees the evidence for him falsely reporting taxes, which is a misdemeanor. The legal strategy to flip this into a felony may be be a bit of a stretch. Saying that paying off Stormy Daniels was a campaign expenditure because it helped his prospects is a slippery slope- almost definitely at a minimum the campaign was part of the reasoning. There are at least a few reasons I can think of why he also might have paid her off.

It seems to me this opens a very wide door for what is considered to benefit a campaign. Would that make Clinton’s Foundation donations a violation because it earned her compassion points? If a candidate has Botox to look younger or “more attractive” how does that factor in? I have no idea.

My concern as someone who does not want to see Trump re-elected is that if this case falls apart, it will bolster his “witch-hunt” narrative and rally his supporters. Just like after impeachments, FBI raid, etc. Not to mention tricking unsavvy people into thinking he’s maybe not that bad of a guy. A failed prosecution could end up helping him.

On top of that you have the complication of Michael Cohen. I don’t think he’s lying in this case, at least not in a substantial way, but he has so little credibility, has no integrity, and is an obvious grifter. I am sure he will be shredded by the defense. Who knows what a jury will think. Plus in general those of stature who against Trump talking about the case I think need to be careful about saying things like we’re going to get him on this little thing because we know he’s guilty of these other things. Ideally he should be prosecuted for those greater crimes and not stretching the laws to fit a goal.

I believe there are more than likely far worse things Trump is guilty of that he could be cleanly prosecuted on. The timing of this case is unfortunate because if he wins, it undermines the more serious investigations as more of the same “trumped up” cases, even if they are not.

Even if he is found guilty of a felon here and loses on appeal, AFAIK that would not affect his ability to run for office. And I cannot imagine he would go to jail for this, especially given how much the laws are being stretched to begin with.
 
And now McCarthy is promising a House investigation into what he is claiming to be politically motivated election interference. So any criminals who want to avoid prosecution should just register with a party other than the one the prosecutor is with and declare themselves a candidate for political office.

The party of law and order has degenerated to the point that they continue to back a guy who incited a violent attack on the Capitol and who stole top secret documents and obstructed efforts to retrieve them. It's party over country for them.

Sadly, I now need to add Mike Pence to the cast of supporting actors, along with Graham and McCarthy.

Just when I started to have a little respect for Pence after he discovered he still possessed a wee bit of backbone by "doing the right thing" (a low bar) on Jan6th, he squandered that short-lived political capital and respect by recently proclaiming "Here we go again. Another politically charged prosecution against the former president of the United States."

As time goes on, it seems the bar for what might be considered a reasonable threshold to indict and convict Trump keeps going up. I'm afraid it'll eventually get to the point where even an act like the one in his infamous comment about shooting someone on Fifth Avenue won't be sufficient in the minds of people who still support him.
